REASONS FOR THE DETERMINATION
|
Suspension of a category 3 aviation medical certificate — The applicant is a 20-year-old man who has had three clusters of seizures between the ages of 11 and 13. His last one was in July 2008. On the advice of his physician, he ceased to take anti-convulsive medication in 2009. He was granted a category 3 aviation medical certificate in 2014 and commenced flight training. In March 2015, he applied for a category 3 aviation medical certificate. However, in April 2015, when the Aviation Medical Review Board (AMRB) reviewed his file, the unanimous opinion was that the applicant had epilepsy and was considered unfit to hold any aviation medical certificate. Further to the applicant’s evidence, the member cannot be persuaded that he does not have epilepsy. Rather, the applicant has epilepsy, and this has serious aeromedical implications. The member finds that the AMRB’s opinion was correct and agrees with the Minister of Transport’s decision to disqualify him. The applicant’s case was reviewed twice, and Transport Canada (TC) came to the same conclusion both times that the risk would be low enough after ten years to reconsider his application. It became evident that this error on the part of TC resulted in a large financial loss for the applicant. However, based on the evidence, the member confirmed the Minister’s decision to suspend his category 3 aviation medical certificate.
