REASONS FOR THE DETERMINATION

Refusal to renew a category 3 aviation medical certificate — In his 20s, the applicant suffered episodes of blurring of vision. These were apparently put down to some sort of mild migraine type of attacks. He suffered another similar episode two years before the hearing following which he has had absolutely no recurrence of symptoms and would appear to be enjoying excellent health. Following this, a diagnosis of transient global amnesia (TGA) was made but has never been proven. As the applicant’s investigations were normal, there is no evidence to suggest that he has had any significant cerebrovascular accident. Additionally, the applicant’s neurologist (second opinion) recently stated that the risk of the applicant having any type of medical occurrence is not significantly greater than any other healthy individual of the same age. For these reasons, the Tribunal member recommends that the matter be referred back to the Minister of Transport for reconsideration.
