The Minister’s decision not to renew an unrestricted category 3 medical certificate is confirmed.

REASONS FOR THE DETERMINATION
|
Refusal to renew an unrestricted category 3 medical certificate — The applicant does possess “an abnormality of his heart which is likely to interfere with the safe operation of an aircraft”. While the probability of the applicant having a dysrhythmia and an internal cardiac defibrillator (ICD) discharge are low, the consequences of such an event while in control of an aircraft would be catastrophic. The granting of a restricted category 3 medical certificate is a reasonable balance between public safety and the applicant’s privilege to fly an aircraft. Therefore, the Minister of Transport’s decision not to renew an unrestricted category 3 medical certificate is confirmed.
