DETERMINATION

The Minister’s decision to refuse to issue any type of aviation permit or licence to the applicant is confirmed.

REASONS FOR THE DETERMINATION

Refusal to issue an aviation medical certificate for any type of licence — Based on the evidence submitted at the hearing, the most reasonable diagnosis in the applicant’s case is a mood disorder, specifically dysthymia and seasonal affective disorder. The member agrees with the Minister of Transport’s witness that these conditions are at the less severe end of the mood disorder spectrum but would still be classified as established neuroses and psychiatric illnesses under Standard 424 of the Canadian Aviation Regulations. The applicant is also on medications, Prozac and Remeron, which both disqualify an applicant from holding a civil aviation medical certificate. Even though the applicant has responded well to these drugs, as long as the applicant remains on these medications, he will be unable to obtain a medical certificate. For these reasons, the Minister’s decision to refuse to issue any type of aviation permit or licence to the applicant is confirmed.
