REASONS FOR THE DETERMINATION

Refusal to issue an aviation medical certificate — The applicant is a high school student who has been an air cadet since the age of 12. He wishes to apply for a private pilot licence. Since an early age, he has suffered a number of serious behavioral disorders. Although many of his symptoms have resolved, he still suffers from Attention Deficit Hyperactivity Disorder (ADHD), for which he is prescribed Concerta and Ritalin medication. The symptoms of the illness are that the patient has a short attention span, is easily distracted, and has trouble managing issues and focusing on a problem. These symptoms are the prime reason why, in accordance with the Canadian Aviation Regulations, the objective of which is air safety, Transport Canada is refusing to issue the applicant an aviation medical certificate for a pilot licence. The evidence clearly shows that the applicant’s behavioural disorders still persist, and his psychiatrist continues to recommend that he take Concerta. These factors disqualify him from having a private pilot licence. The member concludes that, at this time, the Minister of Transport was correct in refusing the applicant an aviation medical certificate. The Minister’s decision not to issue an aviation medical certificate is confirmed.
