REASONS FOR THE DETERMINATION

Refusal to issue a restricted category 1 aviation medical certificate — The applicant has had type I diabetes since the age of six. He is well controlled and has recently been granted a restricted category 3 aviation medical certificate. He had been advised by Transport Canada (TC) that he will not be considered fit for a restricted category 1 aviation medical certificate due to national and international aviation guidelines regarding insulin-dependent diabetic ab initio pilots. A common theme runs through this entire case: risk of incapacitation, hypoglycemia and what happens if this occurs in flight. The applicant is currently holding his own, but he has been assessed as presenting a moderate to high risk. TC has made every effort to give him the maximum accommodation allowable within its policy. There is a fine balance that physicians and regulators need to consider between allowing a certain risk and ensuring public safety. With an applicant assessed to be in a medium to high risk category, nothing presented to the member suggests that the applicant is fit to hold a restricted category 1 aviation medical certificate. The decision of the Minister of Transport not to issue a restricted category 1 aviation medical certificate is confirmed.
