The member confirms the Minister of Transport’s decision to cancel the temporary marine medical certificate issued to the applicant.
|
REASONS FOR THE DETERMINATION
Cancellation of a temporary marine medical certificate — The applicant’s disease (bipolar disorder) has been evolving since 1994 with severe episodes of relapse, recurrence, and exacerbation. His June 2009 episode was particularly disturbing, since there is no evidence that was provided which shows a serious psychiatric medical monitoring or rehabilitation for alcohol and drug addictions, or regular monitoring by specialized workers for this kind of problem. For the drug addiction, the Tribunal must also take into consideration the four following factors:
· chronic abuse of one or more substances,
· ensuing prolonged addiction,
· habits of consumption, and
· remission date.
Based on these reasons, the applicant is not suitable to hold a position of seaman. The Minister of Transport’s decision is confirmed.
