The member confirms the Minister of Transport’s decision to impose a limitation of “No Watchkeeping” on the applicant’s marine medical certificate.

REASONS FOR THE DETERMINATION
Limitation of “No Watchkeeping” on a marine medical certificate (MMC) — The applicant was diagnosed with colour blindness. Transport Canada’s expert witness clearly established that being able to recognize the colours of navigation lights and buoys is essential for a bridge watch rating. This is both an international and Transport Canada standard. The purpose of this requirement is to avoid the risk of collision or grounding. The member determined that the applicant was not discriminated against as the Minister of Transport (Minister) has demonstrated that colour recognition (red portside and green starboard) is an occupational requirement in the marine sector. The Minister’s decision to impose a limitation of “No Watchkeeping” on the applicant’s MMC is confirmed.
