DETERMINATION

The Minister of Transport’s decision that the applicant is fit to hold a marine medical certificate with the limitation of “no watchkeeping” is confirmed.

REASONS FOR THE DETERMINATION

Limitation on a marine medical certificate – no watchkeeping –

The applicant has been competently assessed with multiple tests and shown to have a significant colour vision defect. The applicant has argued that he can fulfill the requirements of ship’s engineer and that his success as a telephone cable splicer, as well as the current observations of the chief engineer on his ship, confirm his abilities. In the interest of general safety, statutes and regulations have been enacted that disadvantage the applicant, and those like him who suffer from colour-defective vision, and impact the applicant’s opportunity for advancement in his career. Nevertheless, the objective of safety in transportation outweighs any perception of unfairness resulting from the Marine Personnel Regulations in this case. The Minister’s decision that the applicant is fit to hold a marine medical certificate with the limitation of “no watchkeeping” is confirmed.
