The decision regarding the limitations on the applicant’s marine medical certificate is referred back to the Minister of Transport for reconsideration.

| REASONS FOR THE DETERMINATION
|
Limitation on a marine medical certificate – Near Coastal Class I, valid for a Canadian Coast Guard vessel only and also including seven other limitations — The applicant’s expert witness is recognized internationally as an authority on bleeding disorders and he treated the applicant. His emphasis on the importance of monitoring the INR (international normalized ratio) is consistent with good medical practice. He stated that the incremental risk in the case of the applicant is not of any consequence, and that the situation where it would make a difference is remote. As he is an expert in bleeding disorders, great weight was given to his opinion. The applicant has sailed for the past three years without incident. He is a highly organized, intelligent and responsible person. These characteristics enable him to have superior control of his INR and, as a result, reduce his bleeding risk relative to others taking Warfarin. For these reasons, the matter is referred back to the Minister for reconsideration.
