REASONS FOR THE DETERMINATION
|
Limitation on a marine medical certificate – Near Coastal Class II – within 25 nautical miles from shore in waters contiguous to Canada, the United States (except Hawaii) or Saint Pierre and Miquelon –
The applicant did not deny that he was taking Coumadin or inferred that there were any flaws in the standards applied to his medical certificate. In the member’s opinion, Transport Canada has proven that by granting this limitation, it is following current regulations and medical standards with regard to the applicant’s medical certificate. The Minister’s decision to place a geographical limitation on the applicant’s medical certificate on the grounds that he is taking anticoagulation medication for a previous pulmonary embolism is confirmed.
