The matter is referred back to the Minister of Transport for reconsideration.

REASONS FOR THE DETERMINATION

Limitation on a marine medical certificate (no watchkeeping). The Minister’s representative commented on the inconsistencies of two earlier medical reports, the applicant’s own self-reported concerns with his vision, and the subsequent medical reports from the attending specialists. He submitted that there is a medical problem at issue which results in the applicant having unreliable vision. However, given the reasonable time and opportunity to reassess, a better medical opinion can be reached. Given the final assessments of the medical doctors that the applicant’s visual ability remains unchanged, and that his vision meets the requirements of both the regulations and guidelines, the matter is referred back to the Minister for reconsideration.
