DETERMINATION

The Minister of Transport’s decision to assign a Near Coastal Class I limitation on the applicant’s marine medical certificate is confirmed.

REASONS FOR THE DETERMINATION

Limitation on a marine medical certificate – Near Coastal Class I – a voyage that is not a sheltered water voyage or a near coastal voyage –

The applicant has severe hemophilia which, according to the evidence, is well-controlled. The applicant’s limitation on his medical certificate was changed from Near Coastal Class II to Near Coastal Class I following a reassessment of his condition. The Minister provided evidence that included two supportive and credible medical reports from the applicant’s specialists to support the change in limitation. As the current international standards for medical conditions indicate that the guidelines would declare a seafarer with hemophilia to be unfit, the applicant’s request for an unlimited certificate could not reasonably be allowed by the Minister. The Minister’s decision to assign a Near Coastal Class I limitation on the applicant’s marine medical certificate is confirmed.
