The Transportation Appeal Tribunal of Canada confirms the Minister of Transport’s decision that the applicant does not meet the requirements for the issuance of a marine medical certificate.

REASONS FOR THE DETERMINATION
|
Refusal to issue a marine medical certificate – It was established that the applicant’s condition dates back to 1992 and includes hospitalization. His psychiatrist confirms the diagnosis of schizophrenia with an acute exacerbation in 2008 and that the use of the potent antipsychotic medication Clozapine in the high dose of 225 mg is required to maintain stability, and monthly blood tests are required to monitor for side effects of the medication. It was also noted how important it was for the applicant to maintain a regular sleep/wake cycle as part of his health and that when he goes out on the water that he has crew who are capable of running the boat for the night shift so that he can maintain his sleep/wake cycle. The member was satisfied that the Minister had clearly established the reasons for the refusal to issue a marine medical certificate, and that this is consistent with the intent of the Marine Personnel Regulations.
