DETERMINATION

The decision regarding the limitation on the applicant’s marine medical certificate is referred back to the Minister of Transport for reconsideration.

REASONS FOR THE DETERMINATION

Limitation on a marine medical certificate – Limited Contiguous Waters Voyage – The issue in this review is whether the Minister erred in placing limitations on the applicant’s marine medical certificate based on a change in visual requirements ratified in the newest STCW (Standards of Training, Certification and Watchkeeping for Seafarers) document. The evidence established that the applicant had performed his duties over the past 30 years in a safe and competent manner. One of the Minister’s witnesses stated that the applicant’s monocular vision was not a hindrance on his ability to safely and effectively perform his duties. According to all the evidence, the applicant is fully capable of performing his role. However, an international standard mandates that limitations be placed on his seafaring activities, irrespective of whether the medical concerns in this case impact his ability to fully and safely perform his responsibilities. In these unique circumstances, the member is respectfully referring the matter back to the Minister for reconsideration to request that the Minister re-evaluate the application of the standards in the context of this very capable mariner.
