| REASONS FOR THE DETERMINATION
|
Issuance of a marine medical certificate with limitations – “Near Coastal Class 11” – within 25 nautical miles from shore in waters contiguous to Canada, the United States (except Hawaii), or Saint Pierre and Miquelon. The applicant, in order to control his atrial fibrillation, is taking prescription Pradax. The Minister of Transport had issued a restriction on his marine medical certificate according to the Physician Guide, which states that any seafarer using anticoagulants may not go beyond “Near Coastal Class I1”. Transport Canada’s guidelines, as well as international standards and guidelines, allow for an individual assessment of a seafarer’s risks, which did not occur in this case. In the member’s opinion, the examination of the relevant factors suggests that the applicant’s use of Pradax does not pose a significant risk to himself, other seafarers, or the general public, as established in the Marine Personnel Regulations. Therefore, the Minister’s decision regarding the limitation is referred back to the Minister for reconsideration.

| TC reconsideration: The applicant will re-apply for a marine medical certificate and if there are no changes to the existing medical condition and there has not been any reverse reaction to the medication used to treat this condition, a marine medical certificate will be issued bearing the “limitation to Canadian registered vessels within waters under Canadian jurisdiction. Invalid for international voyages.”
