REASONS FOR THE DETERMINATION
|
Limitation on a marine medical certificate – “Limited, contiguous waters voyage – must carry self-administered medications”. The applicant provided ample evidence that he is successfully managing his diabetes. However, the member agrees with the evidence provided by the Minister in terms of the importance of respecting international standards and guidelines. It is not the member’s duty to examine if the international guidelines are fair or correct, only to determine whether Transport Canada’s decision was made fairly and in accordance with the relevant guidelines. The member was satisfied that the decision of the Minister in this case did adhere to the appropriate national and international standards and guidelines. The Minister’s decision to assess the applicant as fit to hold a marine medical certificate with limitations is confirmed.
