The Minister’s decision is confirmed.

REASONS FOR THE DETERMINATION

Refusal to issue a marine medical certificate (MMC) without limitations. The applicant was diagnosed with bipolar disorder in 1993. In 2012, following a relapse while working for several years as a marine engineer, the Minister of Transport issued him an MMC with two restrictions: no guard / travel in sheltered waters. As this is the applicant’s third relapse, there is a persistent risk of occurrence. According to the ILO/IMO guidelines, persons with this diagnosis are normally considered unfit for sea service on a permanent basis. Transport Canada, in view of the applicant’s work experience, has tried to accommodate him as much as possible by allowing him to work within limited geographic boundaries. The discretionary decision of the Minister is deemed relevant and appropriate.
