REASONS FOR THE DETERMINATION
|
Issuance of a Limited Contiguous Waters Voyages (LCWV) marine medical certificate (MMC) — The applicant has been a diabetic patient for approximately 17 years, and since 2010, insulin‑dependent. Subsequently, Transport Canada (TC) issued the applicant an MMC with a restriction to LCWV. In assessing the applicant, TC applied the IMO/ILO guidelines, and the TC Physician Guide. As a result of the restriction on his MMC, the applicant was removed from his sea duties as the chief engineer and transferred ashore. It is clear to the member that considering that the applicant is a seafarer who is insulin-dependent, TC has applied considerable flexibility in assessing and assigning the applicant a limited MMC. Any more flexibility could compromise his safety, and that of his crew and the vessel at sea. In this instance, the Minister has demonstrated that it has reasonably considered and applied the policy and guidelines. Ensuring safety is of paramount importance. The Minister’s decision to issue a limited MMC to the applicant is confirmed.
