| REASONS FOR THE DETERMINATION
|
Issuance of a Near Coastal Class 2 (NCC2) marine medical certificate (MMC) — The applicant has suffered from an anti-phospholipid disorder and to prevent having a stroke or embolism, he has been prescribed Warfarin since 2001. He retired in 2010 and has since been in a “casual call-back situation with the Canadian Coast Guard (CCG). Until 2014, he was given an unlimited fitness-for-sea certificate by Health Canada (HC) and CCG. However, in accordance with the guidance contained in the Physician Guide and the ILO/IMO guidelines on the medical disposition of seafarers taking anticoagulants, the applicant was issued an MMC with a limitation of NCC2. As a chief engineer, he is at a risk of sustaining an injury and therefore of having a major bleed while at sea. Therefore, he needs to be restricted to operate closer to shore in order to be near a dedicated medical facility to receive the urgent antidote to the anticoagulant medication. As the applicant is also in a safety-critical occupation, if he should have such a bleed, not only would his own safety be in jeopardy, but also that of his crew, the vessel, the cargo and the environment. The decision to impose this limitation constitutes the best accommodation for him considering his medical condition. The member confirms the Minister’s decision.
