REASONS FOR THE DETERMINATION
|
Refusal to issue a maritime medical certificate (MMC) without limitations — In 2010 and 2012, the applicant was issued an MMC without limitations. In 2014, due to an early cataract, he no longer met the standards to perform watchkeeping duties. Consequently, he was issued a provisional MMC that allowed him to function on deck without limitations. The Minister’s evidence showed that the limitations registered on the applicant’s MMC were necessary in the interest of maritime safety. The Minister lacked sufficient medical information regarding the existence and severity of the applicant’s medical condition, the use of certain medications such as Plavix, and the potential safety risk imposed. In this case, the applicant did not provide TC fully satisfactory information that could justify lifting the limitations and meeting the requirements for an MMC without limitations. The member agrees with the Minister’s position in not removing the limitations on the applicant’s MMC.
