REASONS FOR THE DETERMINATION
|
Issuance of a marine medical certificate (MMC) without limitations — In April 2015, the applicant was assessed as fit and issued an unlimited MMC that was valid until December 2016. However, in October 2015, and again in March 2016, he received MMCs that imposed a limitation of NNCII (restricting him to working 25 miles offshore), valid until June 2017. Finally, on June 22, 2016, the applicant was issued a fourth MMC that marked again an NNCII, but was valid on Canadian Coast Guard vessels only, with no other limitations than no lone watchkeeping and yearly reporting from a family physician. This last certificate was valid until September 22, 2016. The member is not convinced that the applicant’s case was thoroughly assessed and that a urologist’s input would have been beneficial to the Minister’s decision. The applicant already has a stone lodged in his kidney which has not moved since at least September 2015. The applicant’s testimony showed that he has been going to sea up to 250 miles offshore infrequently and 100 miles offshore all the time with no problem until at least June 2016, and the stone is still stuck there. In the member’s opinion, the applicant’s request not to be issued a restricted MMC is a very valid one. The member is referring the matter back to the Minister for reconsideration.
