| REASONS FOR THE DETERMINATION
|
Refusal to renew a category 3 aviation medical certificate — The applicant had a very serious seizure of unknown cause and suffered a stroke, from which he has fully recovered. He has presently discontinued his medication of Aspirin and Dilantin for these two conditions. Subsequently, Transport Canada (TC) refused to renew his aviation medical certificate due to the risk to flight safety. The applicant has had not one, but two very serious life-threatening events. One or the other, or both of them together, could have extremely serious consequences on flight safety. Guidelines have been established in the TC Handbook for Civil Aviation Medical Examiners and the International Civil Aviation Organization Manual of Civil Aviation Medicine. If the risk is more than between 1-2%, this is one of the regulatory cut-off points that can guide the physician in approving or denying a medical certificate. In reviewing the applicant’s case, the Aviation Medical Review Board have concluded that considering his medical history, the risk of incapacitation is too high to allow the applicant to hold an aviation medical certificate. The member agrees with this conclusion and confirms the Minister of Transport’s decision not to renew the applicant’s aviation medical certificate.
