The member referred the matter back to the Minister of Transport for reconsideration.

REASONS FOR THE DETERMINATION
|
Suspension of a medical certificate β The member does concur that there is no dispute that the applicant used to suffer from an alcohol abuse illness, and while he did try to abstain from alcohol in the past, he has had no less than four relapses. However, the applicant has abstained from alcohol for the past 15 months, and the member tends to believe the applicant that this is a permanent decision. The Canadian Aviation Regulations do prohibit any established medical history or clinical diagnosis of alcoholism; however, it also states that βAn applicant providing documented proof of recovery from alcohol or chemical dependence or abuse may be considered fit.β Consequently, the member referred the matter back to the Minister of Transport for reconsideration.
