The Tribunal member is confirming the Minister of Transport’s decision not to renew the applicant’s medical certificate.

REASONS FOR THE DETERMINATION
|
Refusal to renew a category 3 aviation medical certificate — Based on the evidence, it seems that the applicant’s condition of multiple lung metastases would put the applicant at a risk for being hypoxic (short of oxygen) at higher altitudes. Even though “the current CAT scan of the brain is negative,” the presence of multiple lung metastases would be expected to increase his risk of eventual development of brain metastases which could present as acute incapacitation as a first manifestation. For these reasons, the Tribunal member is confirming the Minister of Transport’s decision not to renew the applicant’s medical certificate.
