DETERMINATION
The Minister of Transport’s decision not to renew the applicant’s aviation medical certificate is confirmed.
REASONS FOR THE DETERMINATION
Refusal to renew an aviation medical certificate — The applicant was committed to a psychiatric hospital following some bizarre behaviour. He spent three weeks in the psychiatric hospital and was discharged with a final diagnosis of schizophrenic‑form disorder. He was put on medication for this and it was urgently recommended that he remain in care and receive treatment for his psychosis. Subsequently, Transport Canada (TC) lifted his medical certificate. It was also noted that the applicant rejected the idea that he had a mental disorder. Based on the evidence, the member concluded that the Minister of Transport was able to prove, based on the opinion of three separate psychiatrists, that the applicant did suffer a psychotic illness in 1997. The applicant did not bring any evidence forward to show any proof that this was not the case. The member advised the applicant that he could not accept his own opinion regarding his psychiatric state but any new information that may come from a psychiatrist or psychiatrists should be submitted to TC for consideration. The Minister’s decision not to renew his aviation medical certificate is confirmed.
