The matter is referred back to the Minister for reconsideration.

REASONS FOR THE DETERMINATION

Suspension of an unrestricted category 1 aviation medical certificate — Following a high-risk transient ischemic attack, the applicant’s unrestricted category 1 medical certificate was suspended. He was eventually issued a restricted category 3 medical certificate. The applicant is requesting that the decision rendered by the Aviation Medical Review Board (AMRB) not to issue him an unrestricted category 3 medical certificate be reassessed. The applicant’s medical specialists provided opinions supporting that he a less than 2% risk of becoming incapacitated in flight due to his medical conditions. However, the AMRB reviewed the applicant’s file on two different occasions, and in both cases, felt his risk of incapacitation was 4% or greater. In the member’s opinion, the AMRB used an erroneous application of the CHA2DS2-VASc score. Therefore, the AMRB should reassess whether the applicant’s medical condition still justifies the conclusion that his risk of incapacitation exceeds what is acceptable for a category 3 medical certificate without restrictions. The matter is referred back to the Minister of Transport for reconsideration.
