DETERMINATION
The matter is referred back to the Minister for reconsideration.
REASONS FOR THE DETERMINATION
Refusal to issue a category 2 medical certificate — The applicant is presently on two psychiatric medications to help with his anxiety/depression. The Aviation Medical Review Board (AMRB) assessed the applicant as “unfit” as an adequate psychiatric report was not submitted. Following the receipt of further reports, the applicant was still considered “unfit” due to the psychiatric medication Lamotrigine which is considered a “contraindication to flying”. The member is of the opinion that the AMRB will require further information to properly assess if the applicant is “fit” or “unfit” to work as an air traffic controller on the basis of his individual circumstances. More detail regarding the applicant’s prior psychiatric history would be appropriate before concluding whether he was “unfit” or “fit”, pursuant to the Canadian Aviation Regulations.
