DETERMINATION

The Tribunal member asks that the Minister of Transport reconsider its decision and grant the applicant a restricted medical certificate for six months “with or as a co-pilot.”

REASONS FOR THE DETERMINATION

Suspension of a category 1 aviation medical certificate — The Tribunal member has no intention and no valid medical reason to question the diagnosis of “migraine with aura.” Each case must be assessed on the merits or even on more detailed criteria. In this case, Transport Canada has referred, at various times, to a three-year, a two-year or even a one-year suspension with restrictions. The Tribunal member has reservations about this, for the following reasons:

1. The applicant is very responsible and well aware of the problem that occurred.

 

2. His medical and surgical history contain only one corrective laser surgery for myopia.

 

3. The applicant certainly had a first episode of migraine with aura as a private pilot with 80 flying hours in January 2001, but the fact remains that while appearing with his flight instructor, the day of the hearing, he firmly intended to complete his training to obtain a commercial pilot licence.

 

4. The applicant underwent a medical follow-up on December 11, 2001, and was to be seen again in April 2002.

 

5. The possible etiology of his episode of migraine with aura on October 5, 2001, could be a lack of sleep (milkman who starts his day at 3:00 a.m.), his being overloaded with work (family, studies, etc.) and a “stressful” situation.

 

The Tribunal member asks that the Minister of Transport reconsider its decision and grant the applicant a restricted medical certificate for six months “with or as a co-pilot.” The applicant’s file is to be reassessed at that time on the basis of his neurological and ophthalmological medical follow-up.
