DETERMINATION

The Minister’s decision not to renew the applicant’s medical certificate is confirmed.

REASONS FOR THE DETERMINATION

Refusal to renew a medical certificate — The Tribunal has reviewed all the documentary evidence submitted by Transport Canada (TC) and it seems obvious that the applicant suffers from bipolar disorder that has been evolving for at least four years, including being hospitalized in 1999, with a diagnosis of megalomaniac and paranoid delusion, in addition to a narcissistic personality. There was another episode in May 2002 where TC was informed by his psychiatrist that the applicant was hypomanic and that the diagnosis was bipolar disorder with narcissistic personality. Subsequently, the applicant was assessed as unfit to fly. Against this abundant documentary evidence, there is still another assessment in 2003 from his psychiatrist, but his clinical history ends in April 2002, that is, before the incident in May 2002. His diagnosis of delusional disorder of the persecutory and grandiose type, in full remission since May 2000, therefore cannot be accepted. Thus, on the balance of probabilities, it seems obvious to the Tribunal member that the applicant remains “unfit,” and the Minister of Transport’s decision not to renew the applicant’s medical certificate is confirmed.
