DETERMINATION
The decision of the Minister declaring the applicant permanently unfit on grounds of the applicant’s clinical evolution since at least 1998 is upheld.
REASONS FOR THE DETERMINATION
Refusal to renew a medical certificate — Based on the evidence provided by the parties, the Tribunal member is compelled to concur with the opinion of the applicant’s psychiatrist, as well as the opinion of all the civil aviation physicians at Transport Canada confirming the diagnosis of bipolar affective disorder in the case of the applicant. The Tribunal member must observe that sacrosanct principle of aviation safety, by reason of which the decision of the Minister of Transport declaring the applicant permanently unfit on grounds of the applicant’s clinical evolution since at least 1998 is upheld.
