REASONS FOR THE DETERMINATION
|
Suspension and refusal to renew the applicant’s aviation medical certificate — In February 2015, the applicant was admitted to emergency due to his inability to speak for 10 to 15 minutes and that episode was followed by a headache. The presiding neurologist established a diagnosis of transient cerebral ischemia (TIA) as well as a differential diagnosis of migraine with aura accompanied by dysphasia. The preponderance of the evidence in the medical investigation of the applicant supports the diagnosis of TIA or, less likely, the diagnosis of migraine with aura, as indicated by the neurologist and the MRI and CT scans of the brain. The Minister of Transport has demonstrated that in aviation, public safety is more important than a pilot's desire to obtain a licence. The Minister was flexible in recommending that the applicant take further steps to renew his licence at the end of the observation period mentioned in the regulations. The Minister’s decision to refuse to renew the applicant’s aviation medical certificate is confirmed.
