REASONS FOR THE DETERMINATION
|
Refusal to issue a marine medical certificate. The applicant suffered from a disorder that required the implantation of an ICD which is incompatible with safely performing seafarers’ duties and no longer meets the medical fitness requirements established in the Marine Personnel Regulations and the International Labour Organization Guidelines on the Medical Examinations of Seafarers. The regulations require that seafarers be able to lift and carry a weight of 22 kg, have the physical capacity to wear breathing apparatus and personal life-saving equipment while climbing ladders etc., and have the mental fitness to meet the occupational and operational requirements of the position that they occupy. The guidelines prescribe that a seafarer with an ICD cannot be considered medically fit, since the condition is incompatible with reliable performance of routine and emergency duties safely or effectively. The Minister of Transport’s decision is confirmed.
