REASONS FOR THE DETERMINATION
|
Refusal to issue a marine medical certificate (MMC) without limitations — The applicant is suffering from well controlled atrial fibrillation (AF), for which he has been prescribed the anticoagulant Pradaxa. This has led to an NC-II (Near Coastal Voyage Class 2) restriction being placed on his MMC. In the interest of his own personal safety, in addition to that of his crew, the cargo and the vessel, Transport Canada has made a reasonable decision to restrict his seafaring operations with an NC-II limitation on his MMC. This decision is based on the Marine Personnel Regulations (MPRs), the International Labour Organization / International Maritime Organization (ILO/IMO) guidelines and the national guidelines. Even though the member is aware of the impact this decision will have on the applicant’s career and employability, in the interest of public safety, the Minister of Transport’s decision is confirmed.
