| REASONS FOR THE DETERMINATION
|
Refusal to renew an unrestricted category 1 aviation medical certificate — Due to the applicant’s medical issues, he was issued a restricted category 1 medical certificate, as he did not meet the required medical standards of the Canadian Aviation Regulations (CARs) Standard 424.17, Physical and Mental Requirement Table, Medical Category 1, paragraphs 1.22 and 3.22, for an unrestricted medical certificate. The applicant had a third bout of kidney stones commencing in March 2017. He has a more frequent history of recurrence, the addition of the gout risk factor, and poor predictability of recurrence from his urologist. Even though he found that was given only very weak evidence on both sides, the member to give more weight to the Minister’s decision. Fitness to go back to work is different from fitness to fly. Renal colic would be disastrous if it occurred during one of the critical phases of flight. The member expressed that he could not be persuaded that at this time it is safe for the applicant to have an unrestricted medical certificate. Transport Canada (TC), the Regional Aviation Medical Officer and the Aviation Medical Review Board have also considered this situation very carefully; and for the next year they are applying caution in giving the applicant a restricted medical certificate. TC should be commended for using maximum flexibility in this case.
