REASONS FOR THE DETERMINATION
|
Refusal to issue a marine medical certificate (MMC) — The applicant was initially issued a provisional certificate. However, the Minister of Transport advised the applicant by letter of the refusal to issue an MMC due to his PTSD. In order for the Minister to reconsider its position, he was requested to provide a detailed report from his psychiatrist, along with a list of medications. The applicant did attempt to comply but was having difficulty obtaining the reports required. Paragraph 270(1)(d) of the Marine Personnel Regulations (MPRs) states that an applicant must possess the physical and mental fitness to meet the occupational and operational requirements of the position they seek to occupy. Furthermore, the Minister must take into account the applicable medical standards and must base its decision as set out in subsection 278(5) of the MPRs. The member agrees that without further information on the applicant’s current medical status, the Minister did not have sufficient information to assess the applicant’s fitness. The Minister’s decision not to issue an MMC is confirmed.
