The member refers the matter back to the Minister for reconsideration.

REASONS FOR THE DETERMINATION

Suspension of a category 3 aviation medical certificate — Following the applicant’s diagnosis, he was followed closely by his cardiologist and underwent periodic echocardiograms to document his heart condition, which was described as being “moderate” to “severe”. The applicant’s most recent echocardiogram appears to demonstrate that he meets the fitness criteria under the Transport Canada (TC) Guidelines for Cardiovascular Health Assessment Guidelines for the Assessment of Cardiovascular Fitness in Licenced Aviation Personnel 2003. As for the fact that parameters of aortic insufficiency may be outside certain guidelines, TC has acted for several years with flexibility in the evaluation of the applicant’s aortic insufficiency, which has not deteriorated in any significant way since 2017. It is therefore reasonable to expect that TC will continue to apply this flexibility. TC must apply the highest possible category based on the medical results of the pilot, in accordance with Standard 424.17(4) of the Canadian Aviation Regulations. The member determines that the Minister of Transport has not proven that the applicant did not meet the conditions for the issuance of a category 3 medical certificate without restrictions. The member refers the matter to the Minister for reconsideration of its two decisions: 1) that to suspend the category 3 medical certificate of the applicant; and 2) that of issuing a category 4 medical certificate with the restriction "glider only, no passenger".
