DETERMINATION
The Transportation Appeal Tribunal of Canada refers the matter back to the Minister of Transport for reconsideration.
REASONS FOR THE DETERMINATION
Suspension of a category 1 aviation medical certificate — In summary, while the recommendation of the Regional Aviation Medical Officer (RAMO) was based on the correct medical information, the recommendation of the Aviation Medical Review Board (ARMB) was not. It is not clear whether the location of the ischemia would have affected the AMRB’s decision to declare the applicant unfit. Nevertheless, the member believes that the faulty information considered by the AMRB could have affected their recommendation. Therefore, the member referred the matter back to the Minister of Transport for reconsideration.
